These Terms of Service describe the terms and conditions for participating in trekking tours, nature experiences, and other activities provided by Kandy Trekking Tours ("we", "us", or "our"). By contacting us, confirming a tour, or participating in an expedition, you agree to these terms.
1. About Our Tours
Kandy Trekking Tours provides guided trekking and tourism experiences in Sri Lanka, including nature trails, mountain treks, cultural experiences, sightseeing tours, and customized tours.
Our tours are designed to provide authentic local experiences while prioritizing customer safety and enjoyment.
Tour arrangements are generally confirmed through direct communication, mainly via WhatsApp, email, or other agreed communication methods.
2. Tour Booking and Confirmation
A tour inquiry does not create a confirmed booking. A tour becomes confirmed only after:
- The itinerary, date, participants, and price have been agreed upon.
- Any required payment or deposit has been received.
- Confirmation has been provided by Kandy Trekking Tours.
3. Pricing and Payments
Tour prices are communicated based on factors including:
- Selected activity and route difficulty
- Number of participants in the group
- Transportation & hotel pickup requirements
- Additional custom services requested
4. Changes to Tour Arrangements
Kandy Trekking Tours reserves the right to modify the itinerary, route, timing, or activities when necessary due to weather conditions, trail hazards, safety concerns, government restrictions, or natural events.
We will make reasonable efforts to provide suitable alternative trails or arrangements where possible.
5. Weather and Natural Conditions
Outdoor activities in Sri Lanka are affected by tropical weather conditions. Rainfall, mist, and trail conditions may change rapidly.
A route or activity may be changed, postponed, or cancelled if continuing creates an unreasonable safety risk. The final decision regarding safety-related changes rests with Kandy Trekking Tours and your assigned guide.
6. Customer Responsibilities
Participants are responsible for:
- Providing accurate information during tour arrangements.
- Informing us of any conditions affecting participation.
- Following guide instructions at all times.
- Respecting local communities, wildlife, and nature.
- Carrying suitable footwear, clothing, and water.
- Taking reasonable care of personal belongings.
7. Physical Requirements and Fitness
Trekking activities in the Knuckles Range or Hanthana Peaks involve uneven terrain, extended walking, elevation changes, slippery surfaces, and outdoor weather.
Participants should ensure they are physically capable of completing the selected activity. If a participant has a medical condition affecting participation, they should inform us before the tour.
8. Safety During Tours
The safety of participants is our highest priority. Participants must follow reasonable guide instructions regarding trail safety, weather warnings, wildlife awareness, and movement restrictions.
A guide may request a participant to stop or modify participation if continuing creates a safety risk for that individual or group.
9. Risks Associated With Trekking
Participants understand that outdoor activities involve inherent natural risks, including slips, uneven terrain, weather shifts, heat exhaustion, insect encounters, or minor outdoor injuries.
While we take all reasonable safety precautions, these natural risks cannot be completely eliminated. By participating, customers acknowledge these outdoor conditions.
10. Personal Belongings
Participants are responsible for their personal items during tours. Kandy Trekking Tours is not responsible for loss, theft, or damage of personal belongings unless caused by our direct negligence. We recommend carrying only essential gear.
11. Children and Minors
Children may participate in appropriate family-friendly tours. Participants under 18 must be accompanied by a parent, guardian, or responsible adult who assumes safety supervision.
12. Photography and Media
Photos or videos may occasionally be taken during tours for memories, documentation, or promotion. Customers who do not wish to appear in photographs may inform the guide beforehand, and we will honor your request.
13. Limitation of Liability
Kandy Trekking Tours takes reasonable steps to provide safe and memorable experiences. However, we are not liable for circumstances beyond control such as extreme weather, natural disasters, government restrictions, or participant actions violating safety rules.
14. Force Majeure
We are not liable for failure or delay in services caused by events outside reasonable control, including severe weather, natural disasters, public emergencies, or road disruptions.
15. Environmental Responsibility
We encourage responsible eco-tourism. Participants must avoid littering, respect wildlife habitats, remain on designated paths, and respect local mountain villages.
16. Intellectual Property
All website content, text, branding, and images belonging to Kandy Trekking Tours may not be reproduced or used without prior written permission.
17. Privacy
Customer information is handled according to our Privacy Policy, which details how data collected during inquiries is processed and protected.
18. Governing Law
These Terms of Service are governed by the laws of Sri Lanka. Any disputes will be handled in accordance with applicable Sri Lankan legal jurisdiction.
19. Changes to These Terms
Kandy Trekking Tours may update these Terms of Service when operational or legal practices change. Revised terms will be published directly on this page.
